By Land and By Sea – An Attorney Breaking Down the Week in Supply Chain
Welcome to By Land and By Sea, a weekly podcast hosted by maritime attorney Lauren Beagen—Founder of The Maritime Professor® and Squall Strategies®.
Each episode breaks down the latest developments in global ocean shipping, surface transportation, and supply chain regulation—in plain language. Whether it's a new rule from the Federal Maritime Commission, a tariff shift from USTR, or a regional port policy taking shape, Lauren explains what’s happening, why it matters, and what it means for your business.
Designed for industry professionals, regulators, shippers, and anyone curious about the mechanics behind global trade, By Land and By Sea offers timely insights at the intersection of policy, logistics, and law.
⚖️ Educational, not legal advice.
🌊 Straightforward, insightful, and actionable.
Because, as we say every week: OCEAN. SHIPPING. MOVES. THE. WORLD.

Topic of the Week (1/20/23):
MSC vs MCS - what's going on in this legal alphabet soup... good for shippers? It's not exactly a yes.

Let's dive in...
1- We're still on final rule watch! The Federal Maritime Commission's Unreasonable Refusal to Deal or Negotiate with respect to Vessel Space Accommodations Final Rule was required (under OSRA 22) to be released December 16, 2022 - still nothing on the website as of this posting.
2- Is the Ocean Shipping Reform Act missing a low hanging fruit? Where is the FMC's ability to deny alliances?

3- Lars Jensen wrote an interesting opinion piece in JOC.com titled "Don’t confuse ocean market collapse with carrier weakness: analyst"
It's a good take on essentially watching the pendulum of the ocean shipping world swing. It was previously in favor of carriers, recently it seems to be moving toward shippers, but don't get too comfortable, the pendulum will continue to swing back and forth until it starts to settle in.
